Court of Protection applications surge to a record high

The number of applications under the Mental Capacity Act (MCA) to the Court of Protection is at the highest level ever recorded, according to recent Family Court statistics. There were three per cent more applications and 15 per cent more orders made between January and March 2018 compared with the same period in 2017.

Just under half of the applications made related to the appointment of a property and affairs deputy. A third of the orders related to deputy appointments for property and affairs.

The statistics also show a 25 per cent increase in deprivation of liberty applications compared to January-March 2017. The number of deprivation of liberty orders increased from 547 to 639.

The rise in Lasting Powers of Attorney (LPA) applications has slowed from the rapid growth seen in 2015 and 2016, with 192,469 LPA applications received between January and March this year, up three per cent on the same period in 2017. Furthermore, there was a 25 per cent fall in the number of Enduring Power of Attorney (EPA) applications compared to the first quarter of 2017.
