INCREASE IN FAMILY COURT FEES

Did you know that from 1 April 2024, court fees in the Family Court have increased by 10%?

Unfortunately, this is no April Fools; with the cost of living crisis showing no signs of slowing down, the Government has made the decision to raise the family court fees by 10% for several reasons:

  • To improve the service provided by HMCTS;
  • Reduce the running costs of the service to the taxpayer; and
  • To subsidise costs of the service.

Just a few of the fees that have increased are:

  • Divorce/nullity/civil partnership dissolution increased from £593 to £652
  • Application for a financial order increased from £275 to £303
  • Application for a financial order by consent increased from £53 to £58
  • Application for an order in Children Act proceedings increased from £232 to £255
  • Other on notice applications increased from £167 to £184

How Does This Affect You

For those who do not qualify for Legal Aid or Help with Fees, such rising court fees can be another good reason to attempt non-court dispute resolution (NCDR).

Common types of NCDR include solicitor-led negotiations and/or mediation.
