Increase to Compensation for Discrimination in the Workplace

 

 

 

 

 

Following the case of Vento in 2002, compensation for injuries to feelings arising from discrimination of any sort in the workplace has been categorised according into three bands, depending upon the seriousness of the injury to feelings (as distinct from psychiatric or similar personal injury, or other heads of compensation).

It has been announced that for cases issued on or after 11 September 2017, the three original Vento bands have been replaced by the following increased bands:-

  • Lower Band (for less serious cases) – £800 to £8,400
  • Middle Band – £8,400 to £25,200
  • Upper Band (for the most serious cases) – £25,200 to £42,000
  • Exceptional Cases – over £42,000

To determine exactly which band a claim would fall into would require a full review of the circumstances and our experts will be able to advise you on these, whether you are a claimant or an employer facing such a claim.
